Terms of service
These terms and conditions (“Terms”) are entered into between Elite International Motors LLC (“Company”) and the Customer (“Customer”) for the sale of goods (the “Goods”). By accepting this, the Customer agrees to be bound by these Terms.
These Terms are executed in English. In the event of any conflict between the English and translated versions, the English version shall prevail.
1. The Company follows a strict returns policy. Goods may be returned for an exchange or credit note subject to the following:
1.1. Goods must be returned within 14 days from the date of purchase.
1.2. The original receipt must be presented at the time of returning the Goods.
1.3. Goods must be returned with the original packaging, sealed and unopened; any Goods that have been opened, used, installed, or damaged by the Customer shall not be eligible for an exchange or credit note.
1.4. In the event the returned Goods are eligible for an exchange or credit note, the Company reserves the right to deduct a restocking fee from the exchange amount or credit note.
2. The Company reserves the right to accept or reject the return of Goods for an exchange or credit note. In the event the returned Goods do not meet the requirements of the returns policy set out herein, The Company shall not be obligated to accept the return or provide an exchange or credit note.
3. In exceptional circumstances or in accordance with these Terms, the Company may, at their sole discretion, refund the Customer via cash or credit/debit card (Cash Customers only) or credit to the Customer’s account (Credit Customers only). In such cases, the refund may take up to 10 working days to be processed.
4. All Goods sold shall not be eligible for any warranty, the extent to which permitted by the applicable law or except as may be provided by the manufacturer. However, in the event any defects or damages are discovered upon delivery of the Goods, the Company shall work with the Customer to resolve the issue in a timely and satisfactory manner.
5. The Company shall not be responsible for any loss or damage in connection with the Goods, including but not limited to, any loss of profit, revenue, or business opportunities. However, the Company shall take reasonable steps to ensure that the Goods are delivered in good condition and are fit for their intended purpose.
6. The Company’s total liability to the Customer in respect of all other losses arising under or in connection with each purchase of Goods by the Customer, whether in contract, tort inclusive of negligence, breach of statutory duty, or otherwise, shall in no circumstances exceed a sum equal to the price payable by the Customer for the Goods purchased.
7. By using the Company’s services, the Customer expressly consents to the Company and/or its affiliates occasionally using their personal information for commercial and promotional purposes, including marketing materials and advertisements. The Customer further expressly consents that the Company and/or its affiliates may occasionally send newsletters, offers, promotions, and general communication and may share the Customer's information with its partners and third-party service providers solely for the purposes noted above. In the event the Customer wishes to withdraw his or her consent to any particular use of his or her personal information, he or she should inform the
Company of this in writing at info@theelitecarparts.com. The Customer should be aware that withdrawing such consent may affect the Company’s ability to provide services to the Customer.
8. The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to any cause beyond its reasonable control, including but not limited to, fire, epidemic, pandemic or disease, acts of God, war, terrorism, or natural disasters.
9. These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation, inclusive of non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute or claim arising out of or in connection with these Terms or its formation, inclusive of non-contractual disputes or claims, shall be subject to the jurisdiction of the courts of Dubai, United Arab Emirates, and the parties hereby submit to the exclusive jurisdiction of those courts for such purposes. The parties expressly waive any right to arbitration. The parties shall endeavour to resolve any disputes amicably in accordance with the UAE consumer law prior to resorting to legal action.
